Terms of Use

The short version: Use NotchBrowser legally and as intended. Don't try to break it, abuse it, or reverse-engineer it. These terms are governed by U.S. law and the Mac App Store terms. If something goes wrong, our liability is limited to what Apple allows. Questions? Email us.

1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("you" or "user") and StartupStartup ("we," "us," or "our"), the developer of NotchBrowser.

By downloading, installing, or using NotchBrowser (the "App"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not download or use the App.

If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of the App

NotchBrowser is a macOS application that provides a compact, notch-integrated web browsing experience designed specifically for MacBook Pro and MacBook Air models with a display notch. The App allows you to browse the web within a non-intrusive interface anchored to the screen notch area.

Key features include tabbed browsing, customizable appearance, keyboard shortcuts, find-in-page, zoom controls, and integration with macOS system features. The App is built on Apple's WebKit browser engine.

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial purposes.

4. Apple's Terms Apply

The App is distributed through the Mac App Store. Your use of the App is also subject to Apple's Standard End User License Agreement (EULA) and the App Store Terms of Service. In the event of a conflict between these Terms and Apple's terms, Apple's terms will control with respect to any Apple-specific provisions.

Apple has no obligation to provide support or maintenance for the App. Any support is provided solely by us.

7. Intellectual Property

NotchBrowser and all related content — including but not limited to the App's source code, design, graphics, user interface, icons, branding, feature set, and documentation — are owned by or licensed to StartupStartup and are protected by applicable intellectual property laws.

The NotchBrowser name, logo, and all associated branding are proprietary to StartupStartup. You may not use our trademarks or branding in any way that could cause confusion or imply endorsement without our prior written permission.

Feedback you provide about the App (bug reports, feature suggestions, ideas) may be used by us to improve the App without compensation or attribution to you.

8. Third-Party Content & Websites

NotchBrowser is a web browser. The content you access through the App is generated by third parties and is entirely outside our control. We do not:

Your interactions with third-party websites — including any data you share with them, any purchases you make, and any content you access — are governed by those websites' own terms of service and privacy policies. We are not a party to those interactions.

Some websites may not render correctly or be fully functional in the App due to compatibility differences. This does not constitute a defect in the App.

9. Purchases & Subscriptions

If NotchBrowser offers in-app purchases or premium subscriptions:

10. App Updates

We may release updates to the App from time to time. Updates may add new features, fix bugs, improve performance, or modify existing features. In some cases, updates may remove features or change functionality.

We recommend keeping the App updated to the latest version to benefit from the most recent security patches and improvements. Older versions of the App may not be supported.

Certain updates may be required for continued use of the App or to maintain compatibility with new macOS versions.

11. Availability & Modifications

We provide the App on a best-effort basis. We do not guarantee that the App will be available at all times, free from errors, or compatible with every macOS version or hardware configuration.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STARTUPSTARTUP, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:

Our total aggregate liability to you for any claims arising from or related to the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim, or $10 USD if you have not made any payments.

You agree to defend, indemnify, and hold harmless StartupStartup and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. NotchBrowser is designed to collect no personal data. Please review our Privacy Policy to understand our practices.

16. Termination

These Terms remain in effect until terminated. Your rights under these Terms will terminate automatically and without notice if you fail to comply with any provision of these Terms.

Upon termination:

We also reserve the right to terminate or suspend access to the App at our discretion, with or without cause, and with or without notice.

17. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or related to these Terms or the App that cannot be resolved informally shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), conducted in English. The arbitration shall take place in Delaware, USA, unless otherwise agreed.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent infringement of intellectual property rights.

Class action waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class, consolidated, or representative action.

18. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and Apple's App Store terms, constitute the entire agreement between you and us regarding the App and supersede all prior or contemporaneous agreements.

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.

Assignment

You may not assign or transfer these Terms or any rights granted to you without our prior written consent. We may assign these Terms without restriction in connection with a merger, acquisition, sale of assets, or by operation of law.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above and, for significant changes, by providing notice within the App. Continued use of the App after changes take effect constitutes your acceptance of the updated Terms.
